Terms of Service

The rules and conditions for using GitScope.

Overview

The Customer's agreement with us

These Terms of Service ("Terms") govern access to and use of the GitScope website and application (collectively, the "Service"), operated by GitScope ("we", "us", or "our").

"Customer" means the individual or organization that accesses or uses the Service.

By accessing or using the Service, the Customer agrees to these Terms and our Privacy Policy. If the Customer does not agree, the Customer must not use the Service.

If the Customer uses the Service on behalf of an organization, the Customer represents that it has authority to bind that organization to these Terms.

The Service

What GitScope provides

GitScope helps teams monitor GitHub repository security and compliance settings, identify issues, and take remedial action from a central dashboard.

We may update, modify, or discontinue parts of the Service at any time. Where reasonably possible, we will provide notice of material changes that affect the Customer's use of the Service.

We do not guarantee that the Service will be uninterrupted, error-free, or that scan results will identify every security or compliance issue in the Customer's repositories.

Accounts

Registration, security, and teams

To use certain features, the Customer must create an account. The Customer agrees to provide accurate information and keep it up to date.

The Customer is responsible for maintaining the confidentiality of account credentials and for all activity under the Customer's account. The Customer must notify us immediately at security@gitscope.app if unauthorized access is suspected.

The Customer may invite team members and assign roles within the Customer's workspace. The Customer is responsible for managing access and permissions for users the Customer invites.

We do not knowingly collect personal data from children under the minimum age applicable in their jurisdiction, even if parental consent is provided. If we become aware that we have inadvertently collected data from a child, we will delete it promptly.

Acceptable use

Rules for using the Service

The Customer agrees not to misuse the Service. This includes, without limitation:

  • Using the Service in violation of applicable law or third-party rights
  • Attempting to gain unauthorized access to the Service, other accounts, or connected systems
  • Interfering with or disrupting the integrity or performance of the Service
  • Reverse engineering, decompiling, or attempting to extract source code except where permitted by law
  • Using the Service to transmit malware, spam, or harmful content

We may suspend or terminate access if we reasonably believe the Customer has violated these Terms.

Monitoring & usage control

Logs and activity we record

To operate, secure, and improve the Service, we monitor and log usage and activity. This may include authentication events, account actions, API requests, feature usage, IP addresses, browser or device information, and other technical data related to the Customer's use of the Service.

We use this information to maintain the security and integrity of the Service, troubleshoot issues, prevent abuse, enforce these Terms, and comply with legal obligations.

By using the Service, the Customer acknowledges that such monitoring and logging may take place. Further details about personal data we collect are described in our Privacy Policy.

Payment

Subscriptions and billing

Some features require a paid subscription. When the Customer subscribes, the Customer agrees to pay the fees shown at checkout for the selected plan and billing period.

Payments are processed by our payment provider, Paddle. By subscribing, the Customer also agrees to Paddle's applicable terms where relevant to the transaction.

Subscriptions renew automatically unless cancelled before the renewal date. The Customer can manage or cancel the subscription from account settings, subject to the terms shown at purchase.

We may change pricing for future billing periods. If a price change applies to the Customer's subscription, we will provide notice before it takes effect.

Refunds

Payments are non-refundable. We do not offer refunds or credits for partial billing periods, unused time, or downgraded features.

Plan downgrades

If the Customer downgrades the plan during an active billing period, the change takes effect at the start of the next billing cycle. We do not provide pro-rata refunds for the difference between plans.

Cancellation

If the Customer cancels the subscription, the paid plan remains active until the end of the current billing period. After that date, the account will move to the applicable free plan or restricted access, unless the Customer subscribes again.

Third-party services

GitHub, Paddle, and other providers

The Service integrates with or relies on third-party services, including GitHub and Paddle. The Customer's use of those services through GitScope is also subject to their respective terms, policies, and acceptable use rules.

GitScope is not responsible for the availability, performance, errors, downtime, outages, or actions of any third-party provider — including GitHub or Paddle — even when they affect the Customer's use of the Service.

Where we use cloud hosting providers or other subprocessors to host or process data, they act on our instructions to support the Service. We remain responsible for providing the Service in accordance with these Terms, but we are not liable for failures caused solely by a subprocessor beyond our reasonable control.

The Customer is responsible for maintaining valid accounts, permissions, and compliance with third-party requirements needed to use the Service.

Customer data

Ownership and privacy

The Customer retains ownership of GitHub organization data and content processed through the Service. We process it on the Customer's behalf to provide the Service.

Our collection and use of personal data is described in our Privacy Policy. By using the Service, the Customer also agrees to that policy.

Intellectual property

Our rights and the Customer's license

The Service, including its software, design, branding, and documentation, is owned by GitScope and protected by applicable intellectual property laws.

Subject to these Terms, we grant the Customer a limited, non-exclusive, non-transferable license to access and use the Service for internal business purposes during the subscription or account period.

The Customer may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted by these Terms or applicable law.

Disclaimers

Warranty and liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, GitScope will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from the Customer's use of the Service.

Our total liability for any claim arising from or relating to the Service will not exceed the amount the Customer paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred euros (€100) if the Customer has not paid us during that period.

Indemnification

Customer responsibility for harm caused by use

The Customer agrees to indemnify, defend, and hold harmless GitScope, its affiliates, and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • The Customer's use of the Service
  • The Customer's violation of these Terms
  • The Customer's violation of applicable law
  • The Customer's infringement of any third-party rights

We may assume the exclusive defense and control of any matter subject to indemnification by the Customer, and the Customer agrees to cooperate with our defense of such claims.

Force majeure

Events outside our reasonable control

GitScope is not liable for any failure or delay in performing our obligations under these Terms where caused by events beyond our reasonable control.

This includes, without limitation, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, internet or telecommunications failures, power outages, cloud infrastructure failures, third-party service outages (including GitHub or Paddle), cyberattacks, or other unforeseeable events.

Our obligations will be suspended for the duration of the force majeure event. Where possible, we will take reasonable steps to resume normal operation.

Termination

Ending Customer access

The Customer may stop using the Service at any time and delete the account from profile settings.

We may suspend or terminate the Customer's access if the Customer violates these Terms, if required by law, or if we discontinue the Service. Where reasonable, we will provide notice before termination.

Sections that by their nature should survive termination — including disclaimers, limitation of liability, and intellectual property — will continue to apply.

Changes to these Terms

How we notify Customers of updates

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Where required by law or where changes are material, we may provide additional notice.

By continuing to use the Service after changes take effect, the Customer agrees to the updated Terms.

Governing law & jurisdiction

Applicable law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.
